Workplace manslaughter offence

From 1 July 2020, an organisation or individual can be charged with the new indictable offence of workplace manslaughter if they negligently breach an applicable duty owed to a person and this causes the death of that person.

The offence applies to employers, self-employed people and 'officers' of the employer.

Maximum penalty for a natural person is 25 years jail, for an organisation 100,000 penalty units, which is currently up to $16.5 million.
