New duty lawyer and Help Before Court guidelines - from 1 March

New duty lawyer and Help Before Court guidelines have been put in place from 1 March 2024.

The new guidelines are the first changes since they were implemented in 2012. The changes include:

  • the Help Before Court and Duty Lawyer Guidelines being combined in one guideline
  • minor changes to the categorisation of offences as minor, straightforward or significant (e.g. careless driving has been moved to minor)
  • the addition of a one-page summary of the guidelines (on the last page)
  • the introduction of a client capability assessment which will give lawyers discretion to change the service level provided to clients based on their capability to advocate in their matter.
  • changes to the definition of priority clients to include clients experiencing family violence or who are on a temporary visa or with uncertain visa status (e.g. unlawful non citizens).
