Alcohol and cycling

Information about the law for drinking alcohol when riding a bicycle.

Road Safety provisions that prohibit drink driving don't apply to cyclists as they refer to 'motor vehicles'.

In the past intoxicated riders have been successfully prosecuted under Summary Offences Act 1966 (opens in a new window) (SOA). However the public intoxication related offences in the SOA were repealed on 7 November 2023 so this avenue of prosecution is no longer available.

As at 7 November 2023 it has not been determined if any offence of cycling while intoxicated will be re-legislated.
